Terms and Conditions of Sale (TCS)

1) Scope of Application

These Terms and Conditions of Sale (TCS) govern the sales made on the website kenshiblades.com, operated by NOITAKY Matthieu EI, registered under number 903 893 378 00013, with its registered office located at 17 rue de l'Amazone, 44470 Carquefou, France.

The trading name used for this website is Kenshi Blades.

Any order placed on the website implies full acceptance of these TCS. The customer acknowledges having read them before confirming the order.

The customer confirms having read and accepted these TCS by ticking the dedicated box before payment and clicking “Order”, “Pay”, or any equivalent checkout button. This action constitutes consent and electronic acceptance of these Terms and Conditions of Sale.

The customer declares having the legal capacity to contract and to purchase the products offered on the website.

The version of the TCS applicable is the one available online on the day of the order. Records such as logs, timestamps, emails, invoices and order confirmations may be kept as proof and may be downloaded or printed by the customer.

2) Products

Products offered for sale on kenshiblades.com are Japanese Damascus knives and related kitchen accessories.

Products are described and presented as accurately as possible. Product pages may include descriptions, photographs, dimensions, technical details, materials, finishes, blade types, handle details and included accessories.

Photographs and visuals are provided for illustration purposes and aim to faithfully represent the products.

However, slight differences may occur between product images and the product received, including natural variations in Damascus patterns, handle materials, colour tones, finishes, handcrafted details or lighting conditions.

Kenshi Blades reserves the right to modify the product selection, product characteristics, descriptions, availability or prices at any time without prior notice.

3) Product Safety and Use

Knives are sharp tools and must be handled with care.

Customers are responsible for using, storing, cleaning and maintaining knives safely and in accordance with their intended purpose.

Kenshi Blades products are intended for kitchen and culinary use only.

Customers must ensure that the products are used responsibly and in compliance with applicable local laws and regulations.

Products must be kept away from children and stored safely when not in use.

Kenshi Blades cannot be held liable for injuries, accidents, misuse, improper handling, unsafe storage, improper maintenance, or use of products contrary to safety recommendations.

4) Prices

Prices are displayed in US dollars (USD $), unless otherwise stated on the website.

Product prices are displayed before order confirmation.

Delivery fees, taxes or other applicable charges, if any, are shown at checkout before payment.

Kenshi Blades reserves the right to update prices at any time. However, products will be charged at the price displayed at the moment the order is placed.

In the event of a manifest pricing error, Kenshi Blades reserves the right to cancel the order and issue a full refund.

5) Order

The customer selects the products and validates the basket.

Before payment, an order summary displays the product details, prices, delivery fees where applicable, taxes where applicable, and total amount.

The order becomes final once payment is confirmed.

Kenshi Blades reserves the right to refuse or cancel an order in case of previous disputes, suspected fraud, payment issue, abnormal order behaviour, product unavailability, manifest error, or breach of these Terms and Conditions of Sale.

After placing an order, the customer receives an order confirmation email at the email address provided during checkout.

6) Payment

Payment is due immediately upon ordering.

Accepted payment methods include those displayed on the website at checkout, such as bank card, PayPal, Klarna, Apple Pay, Google Pay, Shop Pay, or any other available payment method.

Transactions are secured via HTTPS and processed by secure payment service providers.

Kenshi Blades never has access to the customer’s full banking or card details.

Payment providers may apply their own terms, verification procedures, fraud prevention checks or payment authorization rules.

7) Delivery

Kenshi Blades currently ships orders to the United States through the standard checkout process.

Delivery fees, if applicable, are displayed in the cart and at checkout before payment.

For orders shipped within the United States, our usual delivery process is:

  • Dispatch time: 3–7 business days
  • Delivery time: 5–7 business days after dispatch
  • Estimated total delivery time: 8–14 business days from the date of your order

Dispatch time refers to the time needed to process, prepare, inspect, pack and hand over the order to the shipping carrier.

Delivery time begins once the parcel has been dispatched and handed over to the carrier.

Delivery times may vary depending on destination, product availability, order volume, parcel size, carrier operations, peak seasons, weather conditions, logistical disruptions, customs checks where applicable, or other circumstances outside our control.

Products are delivered to the address provided during checkout.

In case of an incorrect or incomplete address resulting in failed delivery, returned parcel, delivery delay or reshipping, additional shipping costs may be borne by the customer.

8) Order Tracking

When available, the customer will receive a dispatch confirmation email containing tracking information once the order has been shipped.

Tracking updates may take some time to appear after the parcel has been handed over to the carrier.

The customer may track the order using the link provided in the dispatch email or through the customer account where available.

9) Receipt and Conformity

The customer must check the condition of the parcel and product upon receipt.

Any issue such as damaged parcel, missing item, incorrect item, defective product or non-compliant product should be reported to Kenshi Blades within 48 hours of delivery at: contact@kenshiblades.com.

The customer should include the order number, a description of the issue, and photos or videos of the product and packaging where relevant.

Photos of any damaged product or packaging may be required to facilitate claim processing with the carrier or supplier.

10) Return Window

The customer may request a return within 14 days from the date the order is delivered.

To request a return, the customer must send an email to: contact@kenshiblades.com specifying:

  • name
  • order number
  • items concerned
  • reason for the return, if the customer wishes to provide it

The return must be made within 14 days after notifying Kenshi Blades of the return request.

Products must be unused, complete, undamaged, in perfect resale condition, and in their original packaging.

The return address will be provided by our customer service upon request. Please contact us at contact@kenshiblades.com before returning any item.

Return costs are borne by the customer unless the product is defective, damaged on arrival, incorrect, or the return is due to an error on our part.

11) Items Excluded from Returns

Returns may not be accepted for the following items:

  • Custom-made or personalised products
  • Engraved knives or products personalised with a logo, name, initials or custom marking
  • Sealed items that cannot be returned for hygiene or safety reasons once opened
  • Products that have been used, washed, sharpened, damaged, altered or are incomplete
  • Products returned without original packaging, accessories, protective covers, boxes or included items
  • Products damaged due to misuse, improper cleaning, improper storage, accident, impact, rust caused by poor maintenance or normal wear and tear

Japanese Damascus knives require careful handling and maintenance.

Damage caused by dishwasher cleaning, soaking in water, cutting bones or frozen food, cutting on hard surfaces, improper sharpening, poor storage, incorrect maintenance or misuse is not considered a product defect.

12) Defective Products or Order Errors

If a product is defective, damaged on arrival, incorrect, or does not match the order, the customer should contact Kenshi Blades as soon as possible at: contact@kenshiblades.com.

The customer should include:

  • order number
  • description of the issue
  • photos or videos of the product
  • photos of the packaging where relevant

If the issue is confirmed, Kenshi Blades may offer, depending on the situation:

  • a replacement item
  • a full refund
  • a partial refund
  • another suitable solution

If a return is required due to a confirmed defective, damaged or incorrect item, return shipping costs will be covered by Kenshi Blades.

13) Refund Policy

Refunds are issued using the same payment method as used for purchase, unless agreed otherwise.

Refunds are issued within 14 days after the returned product is received and verified, where the return is approved.

No refund may be issued for incomplete, used, damaged, altered or non-compliant returned products.

Refunds may be refused or partially reduced if the returned item shows signs of use, washing, sharpening, wear, misuse, damage, missing packaging, missing accessories or improper handling.

Please note that your bank, card issuer or payment provider may require additional time to post the refund to your account after it has been processed.

14) Product Availability

Product availability is displayed on the website where applicable.

In case a product becomes unavailable after the order is placed, the customer will be informed by email and offered the choice to:

  • wait for restocking, where possible
  • choose an alternative product, where available
  • or receive a full refund

15) Liability

Kenshi Blades is not liable for damages caused by misuse of the products.

Kenshi Blades is not responsible for delays or delivery failures due to events outside its reasonable control, including but not limited to strikes, severe weather, transport issues, carrier delays, customs checks where applicable, logistical disruptions, technical issues, force majeure, incorrect delivery information, or customer absence during delivery.

Within the limits permitted by applicable law:

  • Kenshi Blades is not liable for indirect damages, loss of opportunity, loss of profit, loss of data, loss of reputation, or other consequential damages arising from use of the website or products.
  • Website access may be interrupted for maintenance, updates, technical issues or force majeure. Kenshi Blades is not responsible for temporary unavailability.
  • Despite our efforts, content errors such as photos, descriptions, specifications, availability or prices may occur. In case of a manifest error, the order may be cancelled with a full refund.
  • Colours, patterns, materials and renderings may vary depending on screens, lighting conditions and natural material variations. Such variations are not considered defects.
  • Links to third-party websites are provided for convenience. Kenshi Blades is not responsible for their content, policies, security or practices.
  • Products are intended for responsible kitchen use. Any unsafe, improper, professional or unlawful use is at the customer’s own responsibility.

Nothing in these Terms and Conditions of Sale limits liability where such limitation is prohibited by applicable law.

16) Personal Data

Personal data is collected for order processing, payment, delivery, customer relations, returns, refunds, fraud prevention, legal compliance and website operation.

Customers may have privacy rights depending on their place of residence and applicable privacy laws.

17) Consumer Protection and Dispute Resolution

Kenshi Blades will review the request and do its best to provide a fair and appropriate solution based on the specific circumstances of the order.

18) Applicable Law and Jurisdiction

These Terms and Conditions of Sale are governed by the laws applicable to the publisher, without prejudice to any mandatory consumer protection rights that may apply to customers located in the United States.

In case of dispute, the parties will seek an amicable resolution first.

Failing that, any dispute relating to the interpretation or execution of these TCS shall be handled in accordance with the applicable legal rules and consumer protection rights depending on the customer’s location and the nature of the dispute.

19) Termination, Cancellation and Suspension

By the seller:

Kenshi Blades may cancel an order or suspend/close an account in case of non-payment, payment failure, fraud, suspected fraud, abuse, abnormal returns, abusive behaviour, manifest error, product unavailability, legal restriction, unsafe order behaviour or breach of these TCS.

Customers are informed accordingly, and payments for unshipped cancelled orders will be refunded.

By the customer:

Customers may request cancellation of an order before it has been processed, prepared, packed or shipped.

Once the order has entered preparation or has been shipped, cancellation may no longer be possible. In that case, the return policy applies where eligible.

Effects:

Termination or cancellation does not affect prior obligations, including payments due, returns, refunds, intellectual property, liability, data protection and applicable law clauses.

20) Modifications to the TCS

Kenshi Blades may update these Terms and Conditions of Sale at any time.

The applicable version is the one available online at the time of the order.

Significant changes may be notified via website banner, email or website update where appropriate.

Orders placed before updates remain governed by the previous version applicable at the time of purchase.

21) Intellectual Property

All content on kenshiblades.com, including texts, descriptions, photos, videos, visuals, logos, trademarks, graphic design, structure, code and databases, is protected by copyright, trademark and intellectual property law.

It is the exclusive property of Kenshi Blades and/or its partners.

Any reproduction, modification, adaptation, translation, extraction, reuse, distribution, download, republication or commercial use, in whole or in part, is prohibited without prior written consent.

Customers receive a personal, non-commercial licence to access and use the website solely for browsing and purchasing products.

Using our product photos, descriptions, logos, videos or visual content on other websites, marketplaces, social media pages or platforms without written permission is strictly prohibited.

Customer-generated content:

By publishing reviews, photos, comments or other content related to Kenshi Blades products, the customer grants Kenshi Blades a non-exclusive, free, worldwide licence to use, reproduce and adapt such content for promotional, commercial or marketing purposes, subject to privacy rights and moderation.

Any infringement may lead to legal action.
